AGREEMENT FOR THE USE OF THE WEB SITE MEXICO-INSIGHTS.COM, "LIVING AT LAKE CHAPALA"

THIS AGREEMENT WAS LAST UPDATED ON SEPTEMBER 28, 2007.

This Agreement governs your use of Mexico-Insights.com, "Living at Lake Chapala" ("LLC"), which is an electronic magazine service.

1. Changes to This Agreement. We may change the terms of this Agreement at any time by notifying you of the change either electronically or in writing. The changes also will appear in this document, which you can access at any time by selecting Terms of Use from the site's link at the bottom of the.

Your use of LLC after changes are made to this Agreement means that you agree to be bound by such changes.

2. Privacy. Registration data and other information about you is subject to our Privacy Policy. If you are located outside of the United States, note that information you provide to us is being sent to the United States. By subscribing to LLC, you consent to your data being sent to the United States. You agree that we may contact you, via email, about your subscription status. We will attempt to contact you via the email address you have provided us in your account information, initially to welcome you as a subscriber, and also to remind you to renew your subscription shortly before it expires. You agree that we may send you these emails, unless you request us not to send them.

3. Fees and Payments. You can find the current Subscription Fees for LLC posted on the Subscription / Renewal Order Options page.

You agree to pay the Subscription Fees incurred in connection with your user name and account for LLC (including any applicable taxes) at the rates in effect when the charges were incurred. Subscription Fees will be billed at the beginning of your subscription, renewal or any additional service provided. Changes in fees or charges made during your currently paid subscription or renewal period will NOT affect you during your current subscription or renewal period.

4. Renewal. Your subscription is NOT renewed automatically. We will attempt to contact you, via the email address you have provided us in your account information, to remind you to renew your subscription shortly before it expires. You agree to pay the Subscription Fees currently in effect when you renew your subscription. You should ensure your email address is current so we may provide you this service.

5. Limitations on Use.

a. Your subscription entitles only one individual to access LLC using the same user name or password, unless we agree otherwise.

b. The content available through LLC is our property, or the property of our licensors, and is protected by copyright and other intellectual property laws. You may display or print the content available through LLC for your personal, non-commercial use only. You agree not to sell, publish, distribute, retransmit, or otherwise provide access to the content received through LLC to anyone without LLC's permission except as permitted by applicable copyright law. Requests for permission to use or reproduce material from MEXICO-INSIGHTS.COM should be emailed to: info@Mexico-Insights.com.

c. You agree not to use LLC for any unlawful purpose. We reserve the right to terminate or restrict your access to LLC if, in our opinion, your use of LLC may violate any laws, infringe upon another person's rights, or violate the terms of this Agreement. Also, we may refuse to grant you a user name that impersonates someone else, is protected by trademark or other proprietary right law, or is vulgar or otherwise offensive.

6. Other Sites. We may link to or promote Web sites or services from other companies on LLC or offer you the ability to download software from other companies. You agree that we are not responsible for, and do not control, those Web sites, services, and software.

7. DISCLAIMERS OF WARRANTIES AND LIMITATIONS ON LIABILITY. YOU AGREE THAT YOUR ACCESS TO AND USE OF LLC AND THE CONTENT AVAILABLE THROUGH LLC IS ON AN "AS-IS", "AS AVAILABLE" BASIS AND WE SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. JUDITH A. KING, MEXICO-INSIGHTS.COM, LIVING AT LAKE CHAPALA, AND THEIR AFFILIATES, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AND LICENSORS ("THE LLC PARTIES") WILL NOT BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANY OTHER PERSON AS A RESULT OF YOUR ACCESS OR USE OF LLC FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, WHETHER OR NOT CHARACTERIZED IN NEGLIGENCE, TORT, CONTRACT, OR OTHER THEORY OF LIABILITY, EVEN IF ANY OF THE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN ANY OF THE EXCLUDED DAMAGES, AND IRRESPECTIVE OF ANY FAILURE OF AN ESSENTIAL PURPOSE OF A LIMITED REMEDY. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE LLC PARTIES' LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW.

8. General. This Agreement contains the final and entire agreement between us regarding your use of LLC and supersedes all previous and contemporaneous verbal or written negotiations, understandings, or agreements regarding your use of LLC. We may discontinue or change LLC, or its availability to you, at any time. If we discontinue or make LLC no longer available to you, we will refund the remaining portion of your Subscription Fee. This Agreement is personal to the individual subscriber, and the rights and obligations specified in this Agreement may not be assigned to anyone else. No third party is a beneficiary of this Agreement.
